诉讼费用都由败诉方负担吗

1、诉讼费用由败诉方负担，胜诉方自愿承担的除外。
2、部分胜诉、部分败诉的，根据案件的具体情况决定当事人各自负担的诉讼费用数额。
3、共同诉讼当事人败诉的，根据其对诉讼标的的利害关系，决定当事人各自负担的诉讼费用数额。

二、诉讼费用负担的其他情形：
1、二审改判，诉讼费负担
二审改变一审作出的判决、裁定的，应当相应变更一审对诉讼费用负担的决定。
2、调解结案的诉讼费承担
经人民调解达成协议的案件，诉讼费用的负担由双方当事人协商解决;协商不成的，由决定。
3、再审的诉讼费负担
(1)依照民事诉讼或行政诉讼审判监督程序，应当交纳案件受理费的再审案件，诉讼费用由申请再审的当事人负担。
(2)双方当事人都申请再审的，诉讼费用依照由败诉方负担规定负担。
(3)原审诉讼费用的负担由人民根据诉讼费用负担原则重新确定。

4、离婚案件诉讼费负担
离婚案件诉讼费用的负担由双方当事人协商解决;协商不成的，由人民决定。
5、撤诉案件诉讼费负担
(1)民事案件的原告或者上诉人申请撤诉，裁定准许的，案件受理费由原告或者上诉人负担。
(2)行政案件的被告改变或者撤销具体行政行为，原告申请撤诉，裁定准许的，案件受理费由被告负担。
6、减少诉讼请求的诉讼费负担
当事人在法庭调查终结后提出减少诉讼请求数额的，减少请求数额部分的案件受理费由变更诉讼请求的当事人负担。

债务人对督促程序未提出异议的，申请费由债务人负担。债务人对督促程序提出异议致使督促程序终结的，申请费由申请人负担；申请人

8、公示催告诉讼费负担
公示催告的申请费由申请人负担。
9、申请执行诉讼费负担
(1)申请费由被执行人负担。
(2)执行中当事人达成和解协议的，申请费的负担由双方当事人协商解决；协商不成的，由决定。
10、申请保全诉讼费承担
申请费由申请人负担，申请人提起诉讼的，可以将该申请费列入诉讼请求。
11、申请撤销仲裁裁决或认定仲裁协议效力诉讼费负担
撤销仲裁裁决或认定仲裁协议效力申请费，由依照谁败诉谁负担规定决定申请费的负担。

12、海事案件诉讼费负担：
海事案件中的有关诉讼费用依照下列规定负担：
(一)诉前申请海事请求保全、海事强制令的，申请费由申请人负担；申请人就有关海事请求提起诉讼的，可将上述费用列入诉讼请求；
(二)诉前申请海事证据保全的，申请费由申请人负担；
(三)诉讼中拍卖、变卖被扣押船舶、船载货物、船用燃油、船用物料发生的合理费用，由申请人预付，从拍卖、变卖价款中先行扣除，退还申请人；

依照特别程序审理案件的公告费，由起诉人或者申请人负担。
14、产案件诉讼费承担
依法向申请破产的，诉讼费用依照有关法律规定从破产财产中拨付。
15、诉讼费增加的负担
当事人因自身原因未能在举证期限内举证，在二审或者再审期间提出新的证据致使诉讼费用增加的，增加的诉讼费用由该当事人负担。
